By downloading, accessing, or using 2ND PRIME AI, you agree to these Terms of Service. If you do not agree, do not use the app.

Service Description

2ND PRIME AI provides fitness and wellness tools that may include workout planning and logging, outdoor activity tracking, nutrition tracking, recovery sessions, Apple Health-powered wellness context, AI-generated guidance, progress tools, Apple Watch experiences, and Community features. The service is intended for personal, non-commercial use unless we agree otherwise in writing.

Wellness Disclaimer

2ND PRIME AI is for fitness and wellness tracking only and does not provide medical advice.

The app does not diagnose, treat, cure, or prevent disease. AI-generated insights, meal estimates, health summaries, recovery guidance, and coaching are for general fitness and wellness tracking only.

Health, Exercise & Nutrition

2ND PRIME AI is not a substitute for care from a physician, registered dietitian, physical therapist, certified personal trainer, or other qualified professional. Automated features may be inaccurate or incomplete. Do not rely on them for medical, dietary, navigation, or emergency-safety decisions.

Stop exercising and seek appropriate care if you experience pain, dizziness, chest pain, fainting, or unusual shortness of breath. Consult an appropriate professional before starting or changing an exercise or nutrition program when you have health concerns or are unsure what is safe for you.

Outdoor Activity & Location

GPS, distance, route, weather, map, and activity information can be delayed, incomplete, or inaccurate. 2ND PRIME AI is not a navigation, rescue, emergency, or safety service. Stay aware of your surroundings, follow local rules, and use appropriate maps, equipment, judgment, and safety precautions for outdoor activities.

Allergies & Nutrition

Meal logging, recipe ideas, analyzed photos, calorie estimates, and macro estimates are for general education and self-tracking. Allergy and dietary filters are best-effort tools and do not guarantee allergen-free food. Always verify ingredients, packaging, preparation, and cross-contact risk yourself.

Community & User Content

Community features may let you create a profile, post activities or routes, share photos or other content, interact with events or people, and send messages. You are responsible for content you submit and must have the rights needed to share it.

You retain ownership of your content. By submitting content through a feature that requires us to host, process, display, transmit, or distribute it, you grant us a limited, non-exclusive license to do those things only as needed to operate, improve, protect, and provide that feature. Content you intentionally make public or share with others may be seen, saved, or reshared by those users.

We may remove or restrict content or accounts when reasonably necessary to enforce these Terms, protect users or the service, respond to reports, or comply with law.

Subscriptions

Paid features are offered through the Apple App Store. Payment is charged to your Apple ID account. Auto-renewing subscriptions continue unless canceled in accordance with Apple's subscription terms. Manage or cancel subscriptions through your Apple ID account settings.

Free trials, if offered, may convert to a paid subscription unless canceled before the trial ends. Founding-member pricing may be offered to a limited number of eligible subscribers. If you subscribe at a Founder rate, that rate remains in effect while that subscription remains continuously active, subject to Apple's billing and subscription terms. If the subscription is canceled, lapses, expires, or otherwise ends, the Founder rate may no longer be available. Other promotional offers may be limited, changed, or ended according to the terms shown at purchase.

Acceptable Use

You agree not to:

• Use the service for unlawful, fraudulent, abusive, threatening, or harmful activity
• Harass, impersonate, exploit, or intentionally mislead other users
• Upload content that is unlawful or that infringes another person's rights
• Attempt to gain unauthorized access to accounts, systems, or data
• Reverse engineer, scrape, overload, disrupt, or interfere with the service except where applicable law expressly permits it
• Use Community or messaging features to distribute spam, malware, or deceptive content

Intellectual Property

2ND PRIME AI, including its software, design, branding, original content, and related intellectual property, is owned by us or our licensors and protected by applicable laws. Subject to these Terms, you receive a limited, non-exclusive, non-transferable license to use the service for its intended purposes.

Third-Party Services

Some features depend on third-party platforms or services such as Apple, Apple Health, App Store subscriptions, maps, infrastructure, analytics, or other integrations. Their availability and terms may affect parts of the service, and we are not responsible for third-party services outside our control.

Disclaimer of Warranties

To the extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or completely accurate operation.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for a claim related to the service is limited to the amount you paid for the service in the twelve months preceding the claim, or fifty U.S. dollars, whichever is greater, except where applicable law requires otherwise.

Changes

We may modify these Terms or the service from time to time. Material changes will be reflected by updating the date on this page. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
